- On March 19, 2018 at 50 NJR 1025, the Department of Corrections published notice of its proposal of amendments to its rules governing medical parole. The proposed amendments expand the eligibility of inmates for medical parole to include inmates who have a permanent physical incapacity that renders the inmate permanently unable to perform the activities of basic daily living, which results in the need for 24 hour care, and did not exist at that time of sentencing.
- On March 19, 2018 at 50 NJR 1036, the Department of Health published notice of its readoption of its rules regarding the Worker and Community Right to Know Act.

- On March 5, 2018 at 50 NJR 933, the State Board of Psychological Examiners published notice of its proposed amendments to its rules governing the evaluation of degrees for individuals who complete their education outside of the United States.
- On March 5, 2018 at 50 NJR 934, the Division of Consumer Affairs published notice of its proposed amendments to the rules governing the Prescription Drug Monitoring program. The proposal adds certain mental health professionals as individuals who can report information to, as well as receive information from, the Prescription Drug Monitoring Program.
- On March 5, 2018 at 50 NJR 984, the Department of Health published notice of its readoption of the rules regarding certificates of domestic partnership.
- On March 5, 2018 at 50 NJR 984, the Department of Health published notice of its readoption of the rules governing the Newborn Biochemical Screening Program.
- On March 5, 2018 at 50 NJR 985, the Department of Banking & Insurance published notice of its readoption of its rules setting forth the Health Care Quality Act’s application to insurance companies, health service corporations, hospital service corporations and medical service corporations.

- On February 20, 2018 at 50 NJR 883, the Office of the Governor published Executive Order Number 4, which mandates that all state entities facilitate enrollment in the Affordable Care Act marketplace.
- On February 20, 2018 at 50 NJR 885, the Office of the Governor published Executive Order Number 6, which mandates that the Department of Health and the State Board of Medical Examiners review all aspects of the medical marijuana program to remove any potential obstructions.
- On February 20, 2018 at 50 NJR 905, the Department of Banking and Insurance published notice of its readoption of its rules governing loss ratio and refund reporting requirements, as well as requests for relief from obligations imposed by the Individual Health Insurance Reform Act.
- On February 20, 2018 at 50 NJR 906, the State Board of Nursing published notice of its readoption with amendments to its rules governing general requirements of licensure, continuing education, and certification of advanced practice nurses. Advanced practice nurses must complete the education required in the regulations no more than two years prior to submitting the application for certification to the Board of Nursing.
- On February 20, 2018 at 50 NJR 917, the Office of the Attorney General published notice of its denial of a petition for rulemaking seeking to permit email submission of Open Public Records Act (“OPRA”) request to agencies within the Department of Law and Public Safety. In denying the petition, the Office of the Attorney General indicated that the on line OPRA request process better assures that a requestor meets the requirements of OPRA and case law by including the specific elements for a valid OPRA request set forth as in the OPRA statute.

Here are the most recent health care related regulatory developments as published in the New Jersey Register on February 5, 2018:
- On February 5, 2018 at 50 NJR 815, the Department of Health published its notice of its adoption of new rules governing hospital financial transparency. Under the new rules, hospitals (or hospital systems that do not issue hospital-specific audited financial statements) will be required to submit audited annual financial statements to the Department of Health within 180 days of the close of its reporting period. In addition, the hospital/health system will be required to post direct links on their website to the audited annual financial statements, and will also be required to hold a public meeting within 60 days of the submission of the audited annual financial statements to the Department of Health. The attendees at the meeting will be entitled to obtain copies of the audited annual financial statements. A submission of cumulative unaudited quarterly financial statements throughout each quarter must also be submitted within 45 days after the close of each quarter.
- On February 5, 2018 at 50 NJR 821, the Department of Health published notice of its readoption of the rules for licensing of nursing home administrators, as well as the rules regulating the Nursing Home Administrators Licensing Board.
- On February 5, 2018 at 50 NJR 829, the Department of Banking and Insurance published notice of its adoption of amendments to its rules, as well as the adoption of new rules, governing prompt payment of claims submitted by health care providers.
- On February 5, 2018 at 50 NJR 869, the Department of Health published notice of its call for Certificate of Need applications for 53 additional adult acute care psychiatric beds in Hunterdon, Morris and Warren Counties.

- On January 16, 2018 at 50 NJR 310, the Department of Community Affairs published notice of its adoption of amendments to the Uniform Construction Code applicable to cooperative sober living residences.
- On January 16, 2018 at 50 NJR 512, the Department of Health published notice of its adoption of new rules implementing the Autumn Joy Stillbirth Research and Dignity Act.
- On January 16, 2018 at 50 NJR 522, the Department of Health published notice of its adoption of amendments to its rules and the adoption of new rules governing hospice licensing standards. Among other things, the amendments and the rule incorporate new standards for licensed inpatient hospice care providers.
- On January 16, 2018 at 50 NJR 528, the Department of Health published notice of adoption of amendments to its rules and adoption of new rules governing designation of a patient caregiver as well as consultation and aftercare assistance training that is required to be provided to a patient’s caregiver.
- On January 16, 2018 at 50 NJR 531, the Department of Health published notice of its adoption of a new rule governing sepsis protocols in hospitals.

- On January 16, 2018 at 50 NJR 578, the Division of Consumer Affairs published notice of its adoption of new rules governing limitations on or obligations associated with the acceptance of compensation from pharmaceutical manufacturers by prescribers. The new rules impose limitations on the amount of compensation that may be accepted by prescribers from pharmaceutical manufacturers in any calendar year. The cap on payments has been set at $10,000, although payments for research activities, royalties and licensing fees are not subject to this cap.
- On January 16, 2018 at 50 NJR 624, the State Board of Examiners of Ophthalmic Dispensers and Ophthalmic Technicians publish notice of readoption of its licensure rules.

Here are the most recent health care related regulatory developments as published in the New Jersey Register on January 2, 2018:
- On January 2, 2018 at 50 NJR 9, the Division of Consumer Affairs published notice of its proposal of amendments to its rules governing prescriptions filled for Gabapentin. The proposed amendments will require New Jersey licensed pharmacies and registered out-of-state pharmacies to electronically transmit information to the Division of Consumer Affairs about prescriptions for Gabapentin.
- On January 2, 2018 at 50 NJR 133, the Office of Children and Families published notice of its adoption of amendments to its rules regarding New Jersey Safe Haven Infant Protection Act procedures and requirements. Among other things, the amendments provide that the person who brings an infant to a police station, fire department, ambulance, hospital, or emergency department is not required to disclose his or her name or the name of the parent, provide any identifying or non-identifying information about the infant or birth family, or provide any background or medical information about the infant or birth family. The amendments also set forth the procedures that hospital staff must undertake if a safe haven infant is dropped off at the hospital. The amendments require the hospital to obtain information regarding the infant and document it in the infant’s medical chart; comply with any court order obtained by the Division of Child Protection and Permanency (including any requirements for testing); notify the Division of Child Protection Permanency of the infant’s anticipated discharge date; and offer the person bringing the infant to the hospital’s services, medical care, or a referral for services, as appropriate.
- On January 2, 2018 at 50 NJR 198, the Department of Banking and Insurance published notice of its adoption of new rules governing pharmacy benefits managers. The new rules set forth the requirements for contracts between a pharmacy benefits manager and a contracted pharmacy, and requires pharmacy benefits managers to certify that new or existing contracts, upon renewal, comply with the requirements set forth in applicable law.
- On January 2, 2018 at 50 NJR 209, the State Board of Medical Examiners published notice of its adoption of amendments to its rules applicable to medical standards governing screening and diagnostic medical testing in practitioner offices. The amendments will implement additional requirements for the ordering and performance of specific tests.
- On January 2, 2018 at 50 NJR 212, the State Board of Nursing adopted amendments to its rules regarding applications for certified home health aide certification.
- On January 2, 2018 at 50 NJR 259, the Department of Health published notice of its cancellation of the Certificate of Need call for new home health agencies. The notice of cancellation indicated that the Department had collected encounter data for calendar years 2013, 2014 and 2015 from licensed home health agencies and calculated need projections to the year 2020 by region. Based upon its analysis, the Department has determined that there is not a sufficient need for additional home health agencies at this time.
- On January 2, 2018 at 50 NJR 260, the Department of Health published notice of a Certificate of Need call for new specialized long-term care beds for pediatric care.
- On January 2, 2018 at 50 NJR 260, the Department of Health published notice of a Certificate of Need call for new specialized long-term care beds for severe behavior management.
